AMROTH BAY HOLIDAYS
BOOKING TERMS

Please read these Terms carefully as they make up your agreement with Us together with your Confirmation 
of Booking and the information on Our Website and in Our brochure. You will also be agreeing to abide by Our 
park rules. These rules incorporate health and safety and any laws and legislation that We must abide by 
including the parks licence agreement issued by the local authority.

We aim to provide Terms and conditions that are easily understandable. If there is any term that you do not 
understand, then please discuss it with Amroth Bay Holiday's representative before signing.

1. DEFINITIONS 
1.1 When the following words with capital letters are used in these Terms, this is what they will mean:
(a) Event Outside Our Control: is defined in clause 14.2;
(b) Booking: your request to Us for the Accommodation;
(c) Accommodation: the accommodation that We are providing to you as set out in the Booking;
(d) Terms: the Terms and conditions set out in this document; and
(e) We/Our/Us: Nigel Clark and Emily Clark, trading as Amroth Bay Holidays.
1.2 When We Use the words "writing" or "written" in these Terms, this will include e-mail unless We say otherwise.

2. OUR CONTRACT WITH YOU
2.1 These are the Terms on which We supply Accommodation to you. 
2.2 Please ensure that you read these Terms carefully, and check that the details on the reservation form are complete and accurate, before you make the Booking. 
2.3 When you submit the Booking to Us, this does not mean We have accepted your Booking. Our acceptance of the Booking will take place as described in clause 2.6. If We are unable to supply you with the Accommodation, We will inform you of this and We will not process the Booking.
2.4 These Terms will become binding on you and Us when We contact you to confirm your Booking, at which point a contract will come into existence between you and Us.
2.5 A reservation submitted online or by email is a Booking. A reservation made over the telephone or via a completed reservation form is a Booking.
2.6 A Booking is only confirmed when you have received a confirmation of your Booking from Us by email or by post.

3. PRICE AND PAYMENT
3.1 The price of the Accommodation will be set out at the time We confirm your Booking. Our prices may 
change at any time but price changes will not affect Bookings that We have confirmed with you.
3.2 These prices include VAT. However, if the rate of VAT changes between the date of the Booking and the 
date for payment, the rate of VAT as at the date of payment will apply.
3.3 If you make a Booking by telephone more than 28 days in advance, We will ask you to pay a deposit of 
25% of the price of the Accommodation subject to a minimum of £50 immediately. If you do not pay the 
balance of the price of the Accommodation 28 days prior to your arrival date your Booking will be 
cancelled.
3.4 Deposits are non-refundable and non-transferable.
3.5 If you make a Booking by telephone less than 28 days in advance, the full amount is payable 
immediately. If you do not make payment immediately then your Booking will be cancelled.
3.6 We accept the following methods of payment
(a) credit or debit card,
(b) bank transfer, quoting your name and arrival date at the park, please request Our bank details 
when making a booking,
(c) building society cheque or postal order, We do not accept personal or business cheques.
3.7 Once your Booking is confirmed you are responsible for payment of the full amount, therefore We 
recommend that you take out suitable holiday insurance.

4. CHANGES TO OUR TERMS
The law and how We have to operate the park may change from time to time. If this happens then We 
may need to update Our Terms. You will be able to find the latest version online at 
www.thebayamroth.co.uk. If We make any significant changes to Our Terms that affect your Booking after 
you have booked, We will give you the option to cancel with a full refund.

5. PROVIDING ACCOMMODATION
5.1 We will supply the Accommodation to you from the date set out in the Booking confirmation, for the 
number of people stated on the Booking confirmation and with any additional services that have been 
requested by you. Only the number of persons stated on the booking confirmation may occupy the 
Accommodation.
5.2 We will make every effort to provide the Accommodation. However, We may be unable to do so due to 
an Event Outside Our Control. See clause 14 for Our responsibilities when an Event Outside Our Control 
happens. 
5.3 We cannot guarantee a specific caravan but will provide Accommodation of the type specified in your 
Booking.
5.4 We may need certain information from you that is necessary for Us to provide the Accommodation, 
including but not limited to:
(a) the number of people for who the Booking is made and their names,
(b) if you wish to bring a dog,
(c) the number of vehicles you will bring,
(d) particular access requirements.
5.5 If you do not, after being asked by Us, provide Us with this information, or you provide Us with 
incomplete or incorrect information, We may make an additional charge of a reasonable sum to cover 
any extra items or work that is required. If you do not pay any additional charge, We may cancel your 
Booking. 
5.6 The lounge sofa bed in each home is not to be used without prior permission from the management. 
There is a charge for use which we will inform you of when you make a booking.

6. SMOKING
Smoking is not permitted inside your Accommodation. You may smoke outside. Please clear away all 
cigarette ends.

7. PARKING
7.1 One car may be parked adjacent to each caravan. Additional cars, trailers or boats must be parked as 
directed by a member of staff. We endeavour to arrange additional parking near to your Accommodation 
but even the furthest parking spaces are but a few minutes’ walk away.
7.2 Cars or trailers must not be driven or parked on the grassed areas of the park.

7.3 Extra car £4 per night, £20 per week. Spaces must be booked prior to arrival.

8. INVENTORY

8.1 Caravans and Cottages are equipped with cutlery, crockery, kitchen utensils, TV, microwave, DVD 
player, bed linen (except Advantage range), pillows, duvets and blankets. Cottages are also equipped 
with towels. All Accommodation includes a housekeeping pack of a washing up sponge, duster, floor 
cloth and a toilet roll.
8.2 Towels, tea towels and consumables are not included in our caravans except for Our Exclusive range, for 
details of additional items available see the Welcome pack list available on Our website or on request 
from Us.
8.3 All beds must be covered with clean linen. Where not included, linen may be hired or guests may bring 
their own clean linen (duvet cover, lower sheet, pillow cases). Please enquire when you book as to linen 
hire charges. Cot linen is not available. Please bring waterproof sheets for all beds used by young 
children. 
8.4 Laundry irons are not permitted in Accommodation (an iron and board are provided in the launderette). 
Hair dryers and straighteners are to be used with great care - they melt carpets & duvet protectors.
8.5 Please note that due to restricted space, only travel cots can only be placed in caravans. These are not 
suitable for children older than 1 year. Cots have to be placed in the lounge, unless one of the single 
beds is removed. Use of both lounge bed and a cot is not possible. 
8.6 Sleeping bags, inflatable mattresses and camp beds are not permitted in Accommodation.

9. CHECKING IN
Your Accommodation is usually ready from 4:00 pm on the day of your arrival. Some holiday homes will 
be ready by 2.30 pm - you are welcome to call in from 2.30 pm but please do not call earlier. Please 
check-in at the reception. If the door is shut, please ring (firmly) the bell by the shop door and wait for a 
member of staff to arrive.

10. CHECKING OUT CLEANING, CARE AND MAINTENANCE
10.1 Please clean your Accommodation before leaving. Turn the fridge off and leave the fridge door open but 
leave gas, electricity and water heater on. Please vacate by 10:00 am on the day of departure.
10.2 You are responsible for your Accommodation and must take reasonable care of it. All damage you cause 
must be reported. The Accommodation and contents must be left in a clean, undamaged condition.
10.3 Unless it is an emergency, We will give you reasonable notice of any maintenance and repairs that must 
be undertaken during your stay. We reserve the right to enter your Accommodation if we have 
reasonable cause to believe you are engaging in illegal or inappropriate behaviour or acting in breach of 
these Terms.

11. ACCESSIBILITY
Please let Us know at the time of booking whether you require aids for access, for example a ramp, 
wheelchair, toilet booster seat, shower seat, bed lever or baby aids such as a cot, high chair, bath or 
blender.

12. IF THERE IS A PROBLEM WITH THE ACCOMMODATION
12.1 In the unlikely event that there is any problem with the Accommodation:
(a) please contact Us and tell Us as soon as reasonably possible,
(b) please give Us a reasonable opportunity to repair or fix it, and
(c) We will Use every effort to repair or fix the defect as soon as reasonably practicable.
12.2 If any problem with the Accommodation that is Our fault means We are forced to cancel your Booking 
We will refund payments made for Accommodation not yet provided to you.
12.3 As a consumer, you have legal rights in relation to this agreement. Advice about your legal rights is 
available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will 
affect these legal rights.

13. OUR LIABILITY TO YOU
13.1 If We fail to comply with these Terms, We are responsible for loss or damage you suffer that is a 
foreseeable result of Our breach of the Terms or Our negligence but We are not responsible for any loss 
or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of Our 
breach or if it was contemplated by you and Us at the time We entered into this contract. 
13.2 Unless We agree in writing otherwise, We only supply the Accommodation for private Use. You agree 
not to Use the Accommodation for any commercial purpose, and We have no liability to you for any loss 
of profit, loss of business, business interruption, or loss of business opportunity.
13.3 We do not exclude or limit in any way Our liability for:
(a) death or personal injury caused by Our negligence or the negligence of Our employees, agents or 
subcontractors, 
(b) fraud or fraudulent misrepresentation.

14. EVENTS OUTSIDE OUR CONTROL
14.1 We will not be liable for compensation, or responsible for any failure to perform any of Our obligations 
under these Terms that is caused by an Event Outside Our Control. 
14.2 An Event Outside Our Control means any act or event beyond Our reasonable control, including without 
limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, 
terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for 
war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure 
of public or private telecommunications networks.
14.3 If an Event Outside Our Control takes place that affects the performance of Our obligations under these 
Terms: 
(a) We will contact you as soon as reasonably possible to notify you; and
(b) We may cancel your Booking and refund your payments, or provide alternative Accommodation to 
you and refund any payments you have made to Us less the cost of alternative Accommodation,
(c) if the cost of the alternative accommodation is greater than the payments you owe Us, you may 
cancel your booking and We will refund the payments you have made to Us.

15. YOUR RIGHTS TO CANCEL AND APPLICABLE REFUND
15.1 If you need to cancel your Booking, please contact Us as soon as possible.
15.2 You have the following rights to cancel a Booking for Accommodation:
(a) you may cancel any Booking by contacting Us within 7 days of receipt of your Booking 
confirmation, We will confirm your cancellation to you and refund payments you have made to us 
less your deposit.
(b) you may cancel any Booking by contacting Us more than 7 days after receipt of your Booking 
confirmation, We will confirm your cancellation to you and refund payments you have made to us 
less the following:
(i) your deposit
(ii) the difference between the amount of your booking and the amount We are able to obtain 
from re-letting the Accommodation. We may have to offer the Accommodation at a discount 
or may not be able to re-let it for the entirety of your Booking or may be unable to obtain a 
re-let at all, in which case you may receive less than the amount of your booking.
15.3 Where you have cancelled a Booking because of Our failure to comply with these Terms (except where 
We have been affected by an Event Outside Our Control), you do not have to make any payment to Us.
15.4 Once We have confirmed your Booking, you may cancel the contract for Accommodation and receive a 
full refund by giving Us written notice if:
(a) We break this contract in any material way and We do not correct or fix the situation;
(b) We change these Terms to your material disadvantage;
(c) We are affected by an Event Outside Our Control.

16. OUR RIGHTS TO CANCEL AND APPLICABLE REFUND
16.1 We may have to cancel a Booking due to the unavailability of key personnel or key facilities without 
which We cannot provide the Accommodation. If this happens:
(a) We will promptly contact you to let you know,
(b) We may cancel your Booking and refund your payments, or offer alternative Accommodation and 
refund any payments less the cost of alternative Accommodation,
(c) If we offer alternative accommodation you may cancel your booking and We will refund the 
payments you have made to Us.
16.2 We may cancel the contract for Accommodation at any time with immediate effect if:
(a) you do not pay Us when you are supposed to.
(b) you break the contract in any other material way and you do not correct or fix the situation when 
We ask you to.

17. ANTI SOCIAL BEHAVIOUR
17.1 If, either prior to your stay or during your stay with Us, your behaviour is antisocial, or in Our reasonable 
opinion is likely to spoil the enjoyment of the park for other users or cause damage to property you will 
be required to leave immediately without refund or compensation. This may include but is not limited to, 
excessively noisy, offensive, illegal or inappropriate behaviour.

18. PETS
18.1 One well behaved and housetrained dog is welcome in some of Our Accommodation, please let Us know 
that you wish to bring a dog with you when you make a booking. If you do not tell Us then We may 
cancel your Booking without refund.
18.2 A refundable good dog bond is payable by you to cover the cost of damage to Accommodation or the 
park, fouling or breach of the park rules. All damage caused by your dog must be paid for by you. We 
will inform you of the cost of the good dog bond when you make a booking.
18.3 We do not accept any other pets without Our written consent.

19. INFORMATION ABOUT US AND HOW TO CONTACT US
19.1 We are a partnership established in England and Wales. Our address is Amroth Bay Holidays, Amroth, 
South Pembrokeshire, SA67 8PR. Our registered VAT number is 742 4433 47 
19.2 If you have any questions or if you have any complaints, please contact Us. You can contact Us by 
telephoning 01834 831 259 or by e-mailing info@amrothbayholidays.co.uk
19.3 If you wish to contact Us in writing, or if any clause in these Terms requires you to give Us notice in 
writing (for example, to cancel the contract), you can send this to Us by e-mail to 
info@amrothbayholidays.co.uk, by hand, or by pre-paid post to Amroth Bay Holidays, Amroth, 
Pembrokeshire, SA67 8PR. We will confirm receipt of this by contacting you in writing. If We have to 
contact you or give you notice in writing, We will do so by e-mail, by hand, or by pre-paid post to the 
address you provide to Us in the Booking.

20. HOW WE MAY USE YOUR PERSONAL INFORMATION
20.1 We will use the personal information you provide to Us to:
(a) provide the Accommodation,
(b) process your payment to Us, 
(c) inform you about similar Accommodation that We provide, but you may stop receiving these at 
any time by contacting Us.
20.2 We will not give your personal data to any third party.

21. OTHER IMPORTANT TERMS
21.1 We may transfer Our rights and obligations under these Terms to another organisation, and We will 
always notify you in writing if this happens, but this will not affect your rights or Our obligations under 
these Terms.
21.2 You may only transfer your rights or your obligations under these Terms to another person if We agree 
in writing.
21.3 This contract is between you and Us. No other person shall have any rights to enforce any of its Terms. 
21.4 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides 
that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
21.5 If We fail to insist that you perform any of your obligations under these Terms, or if We do not enforce 
Our rights against you, or if We delay in doing so, that will not mean that We have waived Our rights 
against you and will not mean that you do not have to comply with those obligations. If We do waive a 
default by you, We will only do so in writing, and that will not mean that We will automatically waive any 
later default by you. 
21.6 These Terms are governed by English law. You and We both agree to submit to the jurisdiction of the 
English courts.
